Unfortunately, I learned this hard lesson from personal experience. Ten years ago, I was a passenger in a car that was hit by a recently licensed 16 year old driver. The car was driven by my friend and owned by her boyfriend, a local attorney who practiced general law.
I suffered serious and permanent injuries in the accident and the medical bills associated with the accident ran well into 5 figures. The accident was clearly the fault of the other driver, and my friend assured me this would be an open and shut case.
At first I was confident in my choice of an auto accident attorney. I also used this attorney to draft contracts for my business and even to prepare power of attorney documents and a will.
It took me about a year to recognize that while my attorney was GREAT at these other tasks, he didn’t HAVE the experience and the knowledge that an attorney who specializes in auto accidents would have. As a result, I began getting a “bad feeling” about my choice of auto accident lawyer.
After three years of excuses from my attorney, I contacted a lawyer who specialized in representing auto accident victims. It was then that I discovered the horrid truth.
Because I had already “hired” my friend’s boyfriend, no other attorney would take the case. Meanwhile, the clock was ticking and if the insurance company could continue stalling – my case might be thrown out of court.
Meanwhile, it was becoming PAINFULLY obvious that my case would need to go to court – and it was equally apparent that my attorney wasn’t prepared to argue in front of a jury.
As a last ditch attempt to avoid going to court, my attorney asked for mediation. He was STUNNED when the insurance company refused to budge from a settlement offer of less than 20% of my medical bills. The attorney who acted as the mediator told my attorney, “This case is worth six figures if you’ll just take it to trial.”
As I overheard that conversation, I realized the horrible truth. The mediator KNEW my attorney’s fear of going to court. Despite the mediator’s advice, I got a phone call the next week from my attorney advising me to take the paltry settlement because he wasn’t be willing to go to court.
